Monday 23 December – Open all day
Tuesday 24 December – Open until 12 midday
Wednesday 25th to Friday 27th December – Closed
Monday 30th December – Open all day
Tuesday 31st December – Open until 12 midday
Wednesday 1st January 2025 – Closed
Thursday 2nd January – Open all day
The last posting day for 2nd class is 19th December and 20th for first class.
The Courts closure dates are December 25th-27th December and 1st January. Therefore, any claim, judgment and warrant requests put through on 24 December 2024 will not be processed until 30 December 2024. Any claim, judgment and warrant requests put through on 31 December 2024 will not be processed until 2 January 2025.

NEW INFORMATION SHEETS & FLOW CHARTS ON DEBT MANAGER
We have created some new information sheets and flow charts on the debt recovery process. You will find them on the welcome page once you have logged in to our online portal, Debt Manager under the “How we work” section. Hopefully these will be of use to you and your teams.
NEW SMALL CLAIMS MANDATORY MEDIATION
We would like to highlight an important update regarding the new Court mediation rule for small claims (under £10,000) which aims to streamline the dispute resolution process.
From 5th November for all new civil claims filed online that are in dispute and under £10,000, Mediation is now mandatory and parties will need to attend a one hour telephone appointment with a mediator to attempt to resolve matters ahead of a Court Hearing. Be aware, cost sanctions may apply for any party not willing to engage in mediation. If you need our help with this, our team are fully equipped to assist you. OUTSTANDING INSTRUCTIONS
As we approach the holiday period, please review your workflow on Debt Manager and provide us with any outstanding instructions as soon as you can. Delays in providing us with them can have an impact on our liquidation rates for you. If you need help or advice with any of your cases in order to progress matters, please email clientservices@legalrecoveries.com with the cases in question and ask for advice.
LEGAL COSTS, INTEREST AND YOUR TERMS AND CONDITIONS
If you want to be able to charge your debtors interest on the outstanding debt and recover your reasonable legal costs we suggest that you undertake a review of your Terms and Conditions to ensure that they contain sufficient contractual provision to enable you to do so.
Although statutory provision does exist for interest, compensation and reasonable legal costs in respect of commercial debtors by way of the Late Payment of Commercial Debts (Interest) Act 1998, legislation is not so generous in the case of a consumer. In terms of the latter interest is only available from the date of issue of court proceedings and the only costs recoverable are, in a lower value debts, limited fixed costs awarded by the Court.
A further word of caution. The Late Payment of Commercial Debts (Interest) Act 1998 will not apply if your Terms and Conditions already contain a substantial remedy in relation to the debt. You must be sure therefore that any provision you make in your Terms and Conditions is what you wish to apply.
STATEMENTS
A friendly reminder not to send statements to your customers once a case has been passed to us. This can cause confusion, especially where cases have progressed to Court and further fees have been applied.
