Defended Claims
The HM Courts & Tribunal Service (HMCTS) has introduced new practice directions for Defended Claims to include mandatory mediation for the “Small Claims Track”, introducing a new track called the “Intermediate Track”.
We anticipate that the change will have a positive impact and expect to see an increase in small claim cases reaching a settlement at the early stage, and that the new intermediate track will bridge the gap between the former fast and multi-track providing a simpler more costs effective process for higher value claims.

Court Delays
We also wanted to let you know that the Civil National Business Centre (CNBC) is reporting further delays. Applications, Consent orders and matters requiring a judge’s review are currently taking four weeks to be logged and referred. Once something is in the queue, it is taking a minimum of 14 weeks for directions to be given and at least another two weeks before the order is typed up and sent.
